1. Agreement to these terms
By visiting merlinoutdoor.com or placing an order with us, you agree to be bound by these Terms and Conditions. Please read them carefully before purchasing.
If you do not agree to these terms, please do not use this website or place an order.
These terms apply to all products sold through merlinoutdoor.com and may be updated from time to time. The version in place at the time of your order will apply to that order.
2. Eligibility
To place an order with Merlin Outdoor, you must:

We take care to describe and photograph our products as accurately as possible. However, please be aware that:

4. Placing an order
When you place an order on merlinoutdoor.com, you are making an offer to purchase the item(s) at the price shown, subject to these terms.
Order confirmation: After placing an order you will receive an automated order confirmation email. This email is an acknowledgement that we have received your order — it does not constitute acceptance of your offer or form a binding contract.
Contract formation: A binding contract between you and Merlin Outdoor is formed only when we dispatch your order and send you a shipping confirmation email containing your tracking number. We reserve the right to refuse or cancel any order before dispatch, in which case a full refund will be issued promptly.
We may be unable to accept an order if:

There has been a pricing or product description error

We are unable to deliver to your location
If we cannot fulfil your order for any reason, we will contact you by email and issue a full refund.
5. Pricing and payment
All prices on merlinoutdoor.com are displayed in British pounds sterling (GBP) and are inclusive of any applicable taxes unless otherwise stated.
Delivery charges are shown separately at checkout. The total price you see before confirming your order, including delivery, is the full amount you will be charged.
We accept payment by major credit and debit cards and PayPal. Payment is taken at the point of order. We do not store your full payment card details.
We make every effort to ensure prices are accurate. In the event of a pricing error, we will contact you before processing your order and give you the option to proceed at the correct price or cancel for a full refund.
We do not apply surcharges for any payment method.
6. Delivery
We aim to dispatch all orders within 1–3 business days of payment being confirmed. Delivery times and costs are set out in full in our Shipping Policy, which forms part of these terms.
Risk in the products passes to you when they are delivered to the address you provided at checkout. If you provide an incorrect delivery address and the order cannot be recovered, we cannot accept responsibility for the loss.
In the unlikely event that your order is lost in transit, please contact us and we will investigate with the carrier on your behalf.
7. Your right to cancel
As a consumer purchasing online, you have the right to cancel your order under the Consumer Contracts Regulations 2013.
You may cancel your order within 14 days of receiving your goods, for any reason, without giving an explanation.
To cancel, notify us in writing at info@merlinoutdoor.com within the 14-day cancellation window. You then have a further 14 days to return the goods to us.

8. Returns and refunds

In summary:

You have 14 days from receipt of goods to notify us of a cancellation

Items must be returned unworn, unwashed, and in original condition with tags attached

Refunds are processed within 14 days of receiving returned goods

Faulty or incorrect items will be dealt with in accordance with the Consumer Rights Act 2015
Your statutory rights as a consumer are not affected by our returns policy.
9. Faulty goods and your legal rights
Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose, and as described.
If your item is faulty or not as described:

Within 30 days of delivery: you are entitled to a full refund

Between 30 days and 6 months: you are entitled to a repair or replacement; if neither is possible, a full or partial refund

After 6 months: you may still have rights, though the burden of proof shifts
To report a faulty item, contact us at info@merlinoutdoor.com with your order number, a description of the fault, and a photograph where possible. We will cover any return postage costs for faulty goods.
10. Limitation of liability
Nothing in these terms limits or excludes our liability for:

Death or personal injury caused by our negligence

Fraud or fraudulent misrepresentation

Any liability that cannot be excluded or limited by UK law
Subject to the above, our total liability to you in connection with any order shall not exceed the total amount paid by you for that order.
We are not liable for:

Loss of profit, revenue, or anticipated savings

Loss arising from events outside our reasonable control (see Force Majeure below)
We do not exclude or limit any rights you have as a consumer under UK law.
11. Force majeure
We will not be liable for any failure or delay in performing our obligations where that failure or delay results from events beyond our reasonable control, including but not limited to: acts of God, extreme weather, postal or carrier delays, industrial action, government restrictions, or interruptions to power or communications.
In such circumstances we will contact you as soon as possible and work to resolve the situation. If we are unable to fulfil your order within a reasonable timeframe, you will be entitled to cancel and receive a full refund.
12. Intellectual property
All content on merlinoutdoor.com — including but not limited to text, images, photographs, videos, the Merlin Outdoor logo, and the Merlin Outdoor Apparel branding — is the property of Merlin Outdoor and is protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, or use any content from this website for commercial purposes without our prior written consent.
Nothing in these terms grants you any rights in our brand name, logo, or any other intellectual property.

Nothing in this section affects your rights as a consumer to bring a claim in the courts of the country in which you are resident.
